How No Win No Fee Works

With no win no fee agreements (also known as a Conditional Fee Arrangements, or CFAs), there are no upfront legal fees, which means anyone who has been involved in an accident that wasn’t their fault can gain access to justice without any financial risk. Your solicitor only gets a fee if your claim is successful. If your claim isn't successful, you won’t pay your solicitor any legal fees.

If your case is successful, typically you will pay 25% (including VAT) of your compensation to your solicitor, although they will discuss any fees before starting your case. To ensure your claim is risk free, your solicitor may take out an insurance policy on your behalf. If you terminate the agreement, you may have to pay fees for the time already spent on your claim, or due to: lack of cooperation, misleading your solicitor, missing medical or expert examinations, or not attending court hearings.

There are some instances where you are not required to use the services of a claims management company, and are able to claim yourself, for free, directly via the relevant ombudsman/compensation scheme. These include:

    - Criminal injuries: The Criminal Injury Compensation Authority (England, Wales, and Scotland) or the Criminal Injury Compensation Scheme (Northern Ireland)

    - Minor road accidents: The Official Injury Claim Portal

    - Accidents involving uninsured drivers: The Motor Insurers' Bureau

    Taxi Crash Passenger Claims

Taxis are a great way of getting about big cities and also are vital means of transport for a night out when you don’t want to drink and drive, but, as with all methods of transport, there is the potential for a road traffic accident which can leave you seriously injured.
Taxi drivers are very experienced drivers and thousands of people put their lives in the hands of these professionals, but accidents can and do happen.

If you have been involved in an accident as a passenger in a taxi, you may be able to claim personal injury compensation on a no win no fee basis from either the taxi company, if the accident was the taxi driver’s fault, or from the other road user who caused the accident. In some circumstances, it can actually be a council or local authority to blame if a dangerous or poorly maintained road was to blame for the accident.

What to do when a Taxi Accident occurs

There are things you can do at the scene of a taxi accident, and shortly after, to help your claim for injury compensation have a better chance of success:-

    • Record the name, address, registration details and company contact details of your taxi driver and taxi.
    • Record the contact details of anybody else involved in the accident.
    • Record the contact details of anyone who witnessed the accident.
    • Take photos of the scene of the accident or draw a rough sketch showing what happened – A witness can do this if you are too injured to do so.
    • Report the accident to the police if somebody is injured – This is a legal requirement but also means that there is an official record of the accident.
    • Seek medical attention – Even if your injuries seem to be mild, you should get a thorough medical check up as things like whiplash can take a few days to develop. Again, this means that there is a record to support your case.
    • Contact a specialist injury solicitor with experience in claiming compensation for road traffic accidents (RTAs) – The sooner you appoint a personal injury lawyer the sooner they can collate evidence such as witness statements, while details are still fresh in people’s minds.

Can I get compensation if I’ve been injured in a Taxi Accident?

You should be successful in your compensation claim if you can prove that you suffered an injury and if the taxi accident was somebody else’s fault. You are the innocent party and if the accident has had consequences for your life then you are entitled to compensation. An accident can affect people in many ways:-

How to get compensation with a Bicycle Accident Claim

A bicycle accident can leave a cyclist with head injuries, injuries to their arms and legs, abdominal injuries or chest injuries, and even cause the cyclist to be killed. If you or a loved one have been injured in a bicycle accident that was caused by another road user or by a dangerous road, you should be able to claim personal injury compensation.

    • Pain and suffering
    • Medical problems – Both short-term and long-term
    • Expenses – You may have incurred expenses like medical bills, prescription charges and travel expenses as a result of your accident.
    • Care – You may now suffer with a condition or disability that needs special attention or care.
    • Loss of earnings – You may be unable to work for a time or unable to work at all. Compensation could make up for lost earnings and future potential earnings.

Personal injury compensation for your taxi passenger accident can help you to rebuild your life and move on.

One thing you do need to be aware of is that your potential compensation payout is likely to be reduced if you were not wearing a seatbelt at the time of the accident. It is now the law to wear a seatbelt in taxis and if you were not wearing one then your injuries could be partly blamed on you not complying to the law. However, you may still be eligible for a decent compensation amount if you can prove that you were not to blame for the accident.
